Terms & Conditions and Waiver of Liability

Applicable to all Personal Training, Classes, and Physical Training Services

 

Provider: Number 1 Athlete (“the Provider” / “we” / “us”)

These Terms & Conditions (including the Waiver of Liability) apply to all participation in physical training services delivered by Number 1 Athlete, including but not limited to personal training (in-person or online), group classes, workshops, and any other physical activity sessions (“the Services”). By ticking the agreement box on our booking platform (or otherwise indicating acceptance), you confirm you have read, understood, and agree to be bound by them. If you do not agree, do not book or attend any Services.

 

Service Description

The Services may include, but are not limited to, personal training sessions (in-person or delivered remotely via video call), group exercise classes, workshops, and other supervised physical training activities. Sessions are held at various venues (which may change from time to time) and/or delivered online, and are supervised by a qualified instructor or coach employed or engaged by the Provider. The specific format, content, and location of each session will be communicated at the time of booking.

 

1. Booking, Payments & Cancellations

•        All bookings are made via our designated booking platform (or any replacement platform notified to you).

•        Payment is due in full at the time of booking unless otherwise stated.

•        Prices are as displayed on the booking platform and may change with notice.

•        Cancellations by you: A full refund will be issued if cancelled 24 hours or more before the scheduled session start time. No refund will be given for later cancellations or no-shows. Refunds are processed via the original payment method.

•        Cancellations or changes by us: We may cancel, reschedule, or relocate a session (e.g. due to low numbers, instructor illness, venue issues, or unforeseen circumstances). We will notify you as soon as possible. You will receive a full refund, credit, or transfer to an alternative session where possible. We are not liable for any consequential loss (e.g. travel costs).

•        We reserve the right to refuse or cancel any booking.

 

2. Voluntary Participation & Acknowledgement of Risks

Participation is entirely voluntary. Even low-impact or supervised exercise carries inherent risks. Risks include (but are not limited to):

•        Muscle or joint strain, sprains, or aggravation of existing conditions

•        Falls, dizziness, loss of balance, or fainting

•        Exacerbation of pre-existing medical conditions (e.g. heart or blood pressure conditions, joint replacements, musculoskeletal injuries)

•        Minor aches, fatigue, or delayed-onset muscle soreness

•        For online sessions: additional risks relating to your personal environment, including trip hazards, unsuitable flooring, or inadequate space

 

The Services are not medical treatment, physiotherapy, or a substitute for professional medical advice. You are strongly advised to consult your GP or healthcare professional before starting and to obtain clearance if you have any health concerns.

 

3. Fitness & Medical Declaration

You represent and warrant that:

•        You are in suitable physical condition for the Services and have no medical condition preventing safe participation (or you have obtained written medical approval).

•        You will immediately stop and inform the instructor if you feel pain, discomfort, dizziness, or anything unusual.

•        You will modify or omit any movement to suit your ability and fitness level.

•        For online sessions: you confirm that your training environment is safe, clear of hazards, and has adequate space and appropriate flooring.

 

Pre-Activity Health Questions (answer honestly – information is confidential and used only for safety):

1.      Has your doctor ever said you have a heart condition or high/low blood pressure? Yes / No

2.      Do you have any joint, bone, or musculoskeletal problems (including recent surgery, arthritis, or joint replacements)? Yes / No

3.      Are you currently taking any medication that could affect balance, blood pressure, or energy levels? Yes / No

4.      Do you have any other condition or limitation that may affect your ability to participate safely? Yes / No

 

If you answer “Yes” to any question, you must consult your GP before attending and inform the Provider. We may request written confirmation before allowing participation.

 

4. Assumption of Risk

You voluntarily assume full responsibility for all risks (known and unknown) arising from participation, including those relating to any pre-existing conditions, your personal training environment (for online sessions), and your own physical fitness.

 

5. Release & Waiver of Liability

To the fullest extent permitted by law, you, your heirs, executors, administrators, and assigns hereby release, waive, discharge, and covenant not to sue Number 1 Athlete, any venue operators, their employees, agents, volunteers, or successors from any and all claims, demands, damages, costs, liabilities, or causes of action (including for ordinary negligence) arising out of or in connection with your participation in the Services.

 

This waiver does not exclude liability for death or personal injury caused by the proven negligence of the Provider, which cannot be excluded or limited under UK law (including under the Unfair Contract Terms Act 1977 and the Consumer Rights Act 2015).

 

This waiver covers all injuries, loss, or damage to person or property occurring during, or as a result of, the Services, including while travelling to or from any venue, and including losses arising from online session environments.

 

6. Indemnity

You agree to indemnify and hold harmless Number 1 Athlete against any loss, liability, claim, damage, or expense (including reasonable legal costs) arising from your breach of these terms or your negligent acts or omissions during participation.

 

7. Conduct & Safety

•        Follow all instructions from the instructor at all times.

•        Inform the instructor of any changes to your health or medication before any session.

•        No disruptive, abusive, or dangerous behaviour is permitted. We may ask you to leave (without refund) if necessary.

•        Wear appropriate clothing and footwear for the activity. Bring water and any personal aids required.

•        For in-person sessions: you are responsible for your own belongings. We accept no liability for loss or damage to personal property.

•        For online sessions: ensure your space is safe and free of hazards. You are solely responsible for your training environment.

 

8. Personal Belongings & Insurance

We provide no guarantee of secure storage at any venue. You participate at your own risk regarding personal belongings. We recommend you hold adequate personal accident or medical insurance if desired.

 

9. Photography, Video & Data Protection

We may take photographs or videos during in-person sessions for records, promotion, or social media (anonymised where possible). You may withdraw consent in writing at any time. Online sessions will not be recorded without your prior agreement.

 

Your personal data (name, contact details, health information) is processed securely for the purposes of booking, safety, administration, and communication, in accordance with UK GDPR and the Data Protection Act 2018. Data is retained only as long as necessary and deleted when you cease participating (unless legally required otherwise). See our Privacy Notice for full details.

 

10. Changes to Services & Terms

We may vary the format, schedule, pricing, delivery method, or venues of the Services with reasonable notice. Continued participation constitutes acceptance of any such changes. We may also update these Terms from time to time; the latest version will apply and will be available on our booking platform or website.

 

11. Governing Law & Entire Agreement

These Terms are governed by the law of England & Wales. If any provision is found to be invalid or unenforceable, the remainder will continue in full force. These Terms (together with any booking platform-specific rules) constitute the entire agreement between you and Number 1 Athlete in relation to your participation in the Services.

 

Declaration & Agreement

By ticking the agreement box on the booking platform, you confirm that:

•        You are aged 18 or over.

•        You have read and understood this document in full.

•        You agree to these Terms & Conditions and the Waiver of Liability.

•        The health information you have provided is accurate and complete to the best of your knowledge.

Provider

Number 1 Athlete — covering all classes, personal training, and sessions.

Purpose

Certain medical issues may mean you should not participate in physical activity without first obtaining your doctor’s approval. This quick screening helps determine if clearance is needed before booking or attending any session (gentle joint care, personal training, group classes, online sessions, etc.).

•        I will stop immediately and inform the instructor or trainer if I feel unwell, experience pain, dizziness, or anything unusual.

•        This screening does not replace medical advice.

•        If my health changes, I will notify Number 1 Athlete and may need to update this screening.

•        This PAR-Q applies to all current and future bookings with Number 1 Athlete.

Declaration & Agreement

By ticking the agreement box on Bookwhen, you confirm that:

•        You have answered NO to all of the questions above, or you have already consulted your GP/doctor and received written clearance if any answer was YES.

•        The health information you have provided is accurate and complete to the best of your knowledge.

•        You understand that participation in any activity is voluntary and entirely at your own risk.

•        You will stop immediately and inform the instructor or trainer if you feel unwell, experience pain, dizziness, or anything unusual during a session.

•        You understand that this PAR-Q does not replace medical advice.

•        You will notify Number 1 Athlete if your health changes and acknowledge that you may need to complete a fresh screening before continuing to participate.

•        This declaration applies to all current and future bookings with Number 1 Athlete until you notify us of a change in your health status.
